§ 4. Product Information
- Information about Products, including their price, description, available variants, materials, colours, sizes, fulfilment time and other essential characteristics, can be found on the pages of the individual Products.
- The products available in the Store, in particular the Signature Corset and the Matching Skirt, are made to order after the order has been placed.
- Products may be personalised according to the parameters selected by the Customer, such as size, colour, neckline shape, lower line of the corset, skirt length, type of fabric or other available options.
- Due to the nature of atelier work, minor differences in the arrangement of the fabric, the structure of the material, the shade of the colour or the details of the hand finishing may occur and do not constitute a defect of the Product, provided that the Product remains in accordance with the order placed.
- The Seller makes every effort to ensure that the photos of the Products reflect their actual appearance as faithfully as possible. However, please note that colours may differ slightly depending on screen settings, the lighting during the photo session or differences between fabric batches.
§ 5. Placing Orders
- Orders can be placed via the online Store.
- In order to place an Order, the Customer selects a Product, specifies the available Product variants and provides the data necessary to fulfil the Order.
- In the case of made-to-order or personalised Products, the Customer is obliged to provide correct information, including the selected size, colour, length, Product variant and other data required for the given Product.
- The Customer is responsible for the correctness of the data and measurements provided.
- Before placing an Order, the Customer may use the Size Recommendation Service, which is intended to help select the best possible size.
- Placing an Order constitutes acceptance of these Terms & Conditions.
- After placing an Order, the Customer receives an e-mail message confirming its acceptance.
- The contract of sale is concluded at the moment the Customer receives an e-mail message confirming that the Order has been accepted for fulfilment, unless individual arrangements provide otherwise.
§ 6. Payments
- All prices given in the Store are gross prices, unless expressly stated otherwise.
- The price of the Product does not include delivery costs, unless the Product description or the Order summary provides otherwise.
- The available payment methods are indicated when placing the Order.
- The Order is accepted for fulfilment once the payment has been credited or once the payment has been confirmed by the payment operator.
- In the event of non-payment within 3 calendar days from the date the Order is placed, the Order may be cancelled.
- In the case of individual orders, the Seller may require the payment of a deposit or advance payment before work on the project begins. Payment details are agreed individually.
§ 7. Order Fulfilment
- Archive of Her Products are created to order, after the Order has been placed and payment has been received.
- The Order fulfilment time is between 14 and 90 days and depends on the type of Product, the personalisation options selected, the availability of materials and the current schedule of the atelier's work.
- The fulfilment time is counted from the moment the payment is credited and all the information necessary to complete the Order has been received.
- After receiving the Order, the Seller will send the Customer an e-mail message with the anticipated completion and shipping date of the Product.
- If the Customer delays the provision of data, measurements, replies or other information necessary to fulfil the Order, the fulfilment time may be extended accordingly.
- In the event of the unavailability of the selected fabric or other material, the Seller will contact the Customer in order to agree on a possible solution, e.g. the choice of a different fabric or a change to the fulfilment date.
§ 8. Size Recommendation Service
- The Size Recommendation Service is an auxiliary service intended to recommend the best possible size on the basis of the measurements submitted by the Customer.
- The Customer may be asked to provide selected measurements, such as bust, under bust, waist, hips or other measurements relevant to the given Product.
- The size recommendation is prepared individually on the basis of the data provided by the Customer.
- The accuracy of the recommendation depends on the correctness and precision of the measurements submitted.
- If the measurements provided significantly deviate from the standard construction of the Product, the Seller may propose a minor construction modification, e.g. in the bust area, at no additional charge, provided that this change is technically possible and is agreed before production begins.
- Using the Size Recommendation Service does not change the nature of the Product as a made-to-order or personalised Product and does not restore the right of return of the Product, where this right is excluded in accordance with these Terms & Conditions.
§ 9. Custom Orders / Individual Orders
- Individual orders are discussed directly with the Seller via the contact form or e-mail correspondence.
- After receiving an enquiry, the Seller will contact the Customer in order to provide the most important information and to arrange a consultation.
- The consultation may take place in person or online, depending on the preferences and possibilities of the parties.
- In the case of Customers from Warsaw and the surrounding area, fittings may take place in person, with the option of arranging a meeting at the Customer's location.
- The individual order process may also be conducted entirely remotely, if the nature of the project allows.
- The details of each individual order, including the scope of the project, price, fulfilment time, payments, fittings and delivery, are agreed individually.
- Individual orders are created according to the Customer's specification and, for this reason, are not eligible for return or exchange, unless the Product is not in conformity with the contract.
§ 10. Delivery
- The Seller ships both within Poland and internationally.
- The delivery time is counted from the moment the parcel is dispatched, and not from the moment the Order is placed.
- Orders within Poland are usually delivered within 1–2 business days from the date the parcel is dispatched.
- The delivery time and cost for international orders are calculated during the selection of the delivery method and depend on the destination country and the chosen shipping option.
- Delivery is carried out via the available carriers, such as InPost, DPD, DHL, UPS or other courier companies indicated when placing the Order.
- In the case of international orders, the Customer may be obliged to pay customs duties, import taxes or other charges required by the country of delivery. These charges are not included in the price of the Product or the shipping cost and remain the responsibility of the Customer.
- The Seller is not liable for delays resulting from the carrier's actions, customs procedures or events beyond the Seller's control.
§ 11. Right of Withdrawal and No Right of Return for Personalised Products
- As a rule, the Consumer and the Entrepreneur with consumer rights have the right to withdraw from a contract concluded at a distance within 14 days, unless a statutory exception to this right applies.
- The right of withdrawal does not apply in respect of Products that are non-prefabricated, manufactured according to the Customer's specification or serving to satisfy her individualised needs.
- Archive of Her Products, in particular the Signature Corset, the Matching Skirt and Custom Orders, are made to order and/or personalised in accordance with the parameters selected by the Customer.
- For this reason, made-to-order and personalised Products are not eligible for return or exchange.
- The absence of a right of return or exchange does not limit the Customer's right to file a complaint in the event that the Product is not in conformity with the contract.
- If, in the future, ready-made products that are non-personalised and not made to order appear in the Store, the rules for the return of such products will be indicated in the Product description or in a separate returns policy.
§ 12. Complaints
- The Seller is liable for the conformity of the Product with the contract in accordance with applicable law.
- If the Product is found not to be in conformity with the contract, the Customer has the right to file a complaint.
- A complaint may be submitted by e-mail to: contact@archiveofher.com
- In the complaint submission, it is recommended to provide:
– first and last name,
– Order number,
– a description of the non-conformity or problem,
– photos of the Product, if they may help in examining the submission,
– the preferred way of resolving the matter.
- Complaints are examined within 14 days of the date the submission is received by the Seller.
- If the complaint is upheld, the Seller will propose a solution in accordance with applicable law, in particular repair of the Product, replacement of the Product, a reduction in price or a refund — depending on the circumstances of the case.
- A Product returned as part of a complaint should be secured in a manner allowing its safe transport.
§ 13. Out-of-Court Complaint and Redress Procedures
- The Consumer may make use of out-of-court methods of handling complaints and pursuing claims.
- Detailed information is available, among others, from municipal or district consumer ombudsmen, consumer organisations and the Provincial Inspectorates of the Trade Inspection.
- The Consumer may obtain free assistance in a dispute with the Seller by using the help of a municipal or district consumer ombudsman.
§ 14. Personal Data
- The controller of the Customers' personal data is the Seller.
- Personal data is processed for the purpose of fulfilling Orders, handling enquiries, conducting correspondence, fulfilling accounting and tax obligations, handling complaints and, if the Customer consents, for marketing purposes.
- Detailed information regarding the processing of personal data can be found in the Privacy Policy available on the Store's website.
§ 15. Newsletter
- The Customer may subscribe to the Archive of Her newsletter by providing her e-mail address and consenting to receiving marketing messages.
- The newsletter may be unsubscribed from at any time via the unsubscribe link available in the e-mail message or by contacting the Seller.
§ 16. Final Provisions
- Contracts concluded via the Store are concluded in the Polish language, unless the parties individually agree otherwise.
- These Terms & Conditions are available on the Store's website in a manner allowing them to be downloaded, saved and reproduced.
- The Seller reserves the right to amend these Terms & Conditions for important reasons, such as a change in the law, a change in the way the Store operates, a change in payment methods, a change in delivery methods or a change in the range of Products offered.
- Orders placed before an amendment to the Terms & Conditions are subject to the Terms & Conditions in force at the time the Order was placed.
- In matters not regulated by these Terms & Conditions, the provisions of Polish law apply.
- These Terms & Conditions are effective as of: 01.07.2026.
